January 18 and March 7, 2024 |
On January 18, 2024, a panel of the Discipline Committee (the Panel) of the College of Medical Radiation and Imaging Technologists of Ontario (the College) found Georgia M. Callendar to have committed acts of professional misconduct in that they:
-
failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the Inquiries, Complaints and Reports (ICR) Committee, and thereby,
-
contravened the Medical Radiation and Imaging Technology Act, 2017, the Regulated Health Professions Act, 1991, and/or the regulations under those Acts, and
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by registrants as disgraceful, dishonourable or unprofessional.
On March 7, 2024, the Panel imposed the following order:
- Georgia M. Callendar shall attend for a public reprimand on a date to be determined by the Registrar, with the fact of the reprimand and the text of the reprimand to appear on the College’s public register;
- The Registrar is directed to suspend Georgia M. Callender’s certificate of registration immediately for a period of five months (to run concurrent with the suspension ordered on January 16, 2024) or longer until they have completed the term, condition or limitations set out below;
- The Registrar is directed to impose the following terms, conditions or limitations on Georgia M. Callender’s certificate of registration, all of which are to be completed at their expense:
- Georgia M. Callender shall successfully complete all outstanding elements of the Specified Continuing Education and Remediation Program (SCERP) ordered by the ICR Committee, including any recommended remediation arising out of her 2020 QA portfolio and the successful completion of the College's Jurisprudence Course and the quiz associated with each module;
- Georgia M. Callender shall unconditionally pass the PROBE ethics course and shall provide proof of successful completion to the Registrar;
- Georgia M. Callender shall respond to all College communications within fifteen days; and
- Georgia M. Callender shall advise the College of any change to any required contact information within fifteen days; and
- Georgia M. Callender is required to pay a portion of the College’s costs in the amount of $8,016.32.

contravened the Medical Radiation and Imaging Technology Act, 2017, the Regulated Health Professions Act, 1991, and/or the regulations under those Acts, and
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by registrants as disgraceful, dishonourable or unprofessional.
On January 16, 2024, the Panel imposed the following order:
- Georgia M. Callender shall attend for a public reprimand on a date to be determined by the Registrar, with the fact of the reprimand and the text of the reprimand to appear on the College’s public register;
- The Registrar is directed to suspend Georgia M. Callender’s certificate of registration immediately for a period of five months or longer until they have completed the term, condition or limitations set out below;

- Georgia M. Callender shall unconditionally pass the PROBE ethics course and shall provide proof of successful completion to the Registrar;
- Georgia M. Callender shall respond to all College communications within fifteen days; and
- Georgia M. Callender shall advise the College of any change to any required contact information within fifteen days; and
- Georgia M. Callender is required to pay a portion of the College’s costs in the amount of $8,745.32.

Luis Fernandez

A panel of the Discipline Committee (the Panel) of the College of Medical Radiation and Imaging Technologists of Ontario (the College) found Luis Fernandez to have committed acts of professional misconduct in that they:
-
contravened the Medical Radiation and Imaging Technology Act, 2017, the Regulated Health Professions Act, 1991, and/or the regulations under those Acts;
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional; and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the Inquiries, Complaints and Reports Committee.
The contested hearing proceeded virtually by way of video conference. Luis Fernandez did not attend the hearing and the Panel granted leave for the hearing to continue despite Luis Fernandez's non-attendance. The Panel entered a plea on Luis Fernandez's behalf denying all allegations contained in the Notice of Hearing.
On April 19, 2023, the Panel imposed the following order:
Luis Fernandez shall attend for a reprimand on a date to be determined by the Registrar;
- The Registrar is directed to suspend Luis Fernandez’s certificate of registration immediately for a period of five months or longer until Luis Fernandez has completed the term, condition or limitation set out below;
- The Registrar is directed to impose the following terms, conditions or limitations on Luis Fernandez’s certificate of registration, all of which are to be completed at Luis Fernandez’s expense:
- Luis Fernandez shall successfully complete all outstanding specified continuing education or remediation program requirements, including the College’s Jurisprudence Course and the quiz associated with each module of that course, and shall provide proof of successful completion to the Registrar prior to their return to practise;
- Luis Fernandez shall successfully complete an individualized ethics course by a College-approved course provider on the issues raised in this case and shall provide proof of successful completion to the Registrar within five months of this order;
- Luis Fernandez shall respond to all College communications within fifteen days; and
- Luis Fernandez shall advise the College of any change to any required contact information within fifteen days; and
- Luis Fernandez is required to pay the College’s costs in the amount of $12,000.00.

Christopher V. Malcolm |
November 29, 2022 |
A Panel of the Discipline Committee found Christopher V. Malcolm, MRT(N), to have committed acts of professional misconduct in that they:
- contravened the Medical Radiation and Imaging Technology Act, 2017, the Regulated Health Professions Act, 1991, and/or the regulations under those Acts,
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the Inquiries, Complaints and Reports (ICR) Committee.
Christopher V. Malcolm admitted the allegations which relate to their failure to comply with a specified continuing education or remediation program (SCERP) ordered by the ICR Committee in December 2020. The SCERP was aimed at improving their understanding of their professional obligations related to the College’s Quality Assurance Program.
The Panel accepted a joint submission on penalty from the College and Christopher V. Malcolm and made an order:
- requiring Christopher V. Malcolm to appear before the Panel to be reprimanded, immediately following the hearing on November 29, 2022, and
- requiring Christopher V. Malcolm to pay the College’s costs and expenses in the amount of two thousand five hundred dollars ($2,500.00), by November 29, 2023.

Janice G. Mizen |
September 2, 2021 |
A Panel of the Discipline Committee found Janice G. Mizen, MRT(R), to have committed acts of professional misconduct in that they:
- failed to maintain the standards of practice of the profession;
- contravened a federal, provincial, or territorial law, a municipal by-law, or a by-law or rule of a hospital within the meaning of the Public Hospitals Act, by accessing the personal health information and/or electronic medical records for one or more patients without consent or proper authorization while employed at St. Mary’s General Hospital in Kitchener, Ontario, contrary to the Personal Health Information Protection Act, 2004, and/or the rules of the hospital; and
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, when they accessed the personal health information and/or electronic medical records for one or more patients without consent or authorization.
The Panel imposed an order:
- requiring Janice G. Mizen to appear before the Panel of the Discipline Committee via video to be reprimanded on September 2, 2021;
- directing the Registrar to impose specified terms, conditions and limitations on Janice G. Mizen’s certificate of registration, requiring that they must successfully complete 1) all of the modules of CMRITO’s online Jurisprudence Course and the associated online quiz, and 2) the online Privacy Awareness in Health Care Training – Ontario course offered by Corridor Interactive, at their expense, by no later than November 1, 2021; and
- directing Janice G. Mizen to pay CMRITO’s costs in the amount of three thousand five hundred dollars ($3,500.00), payable by no later than September 2, 2022.

Patrick M. Jew |
February 7, 2020 |
A Panel of the Discipline Committee found Patrick M. Jew, MRT(R), guilty of professional misconduct in that he:
- engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, or unprofessional; and
- practised the profession while his certificate of registration was suspended, at Georgetown Hospital, Halton Healthcare, on or about January 22 and 23, 2019.
The Panel imposed an order:
- requiring Patrick M. Jew to appear before the Panel of the Discipline Committee to be reprimanded on February 7, 2020;
- directing the Registrar to suspend Patrick M. Jew's certificate of registration for a period of one month, from April 1, 2020 through April 30, 2020; and
- directing Patrick M. Jew to pay the College’s costs in the amount of two thousand five hundred dollars ($2,500.00), payable by certified cheque, on February 7, 2020

Misbahuddin Ahmed |
November 30, 2018 |
A Panel of the Discipline Committee (the Panel) of the College of Medical Radiation Technologists of Ontario found Misbahuddin Ahmed to have committed acts of professional misconduct in that he:
- Has been found guilty of an offence that is relevant to his suitability to practise, in particular when he committed the following offences:
- Conspiring, with certain other individuals to commit an indictable offence, namely knowingly facilitating a terrorist activity, contrary to section 83.19 of the Criminal Code, thereby committing an offence under subsection 465(1)(c) of the Criminal Code; and/or
- Knowingly participating in or contributing to, directly or indirectly, any activity of a terrorist group for the purpose of enhancing the ability of a terrorist group to facilitate or carry out a terrorist activity, contrary to section 83.18(1) of the Criminal Code;
- Contravened a federal law, namely the Criminal Code of Canada, and that the contravention is relevant to his suitability to practise, in particular when he committed the following offences:
- Conspiring, with certain other individuals to commit an indictable offence, namely knowingly facilitating a terrorist activity, contrary to section 83.19 of the Criminal Code, thereby committing an offence under subsection 465(1)(c) of the Criminal Code; and/or
- Knowingly participating in or contributing to, directly or indirectly, any activity of a terrorist group for the purpose of enhancing the ability of a terrorist group to facilitate or carry out a terrorist activity, contrary to section 83.18(1) of the Criminal Code; and/or
- Engaged in conduct or performed an act relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional, in particular when he committed the following offences:

November 15, 2018 |
A Panel of the Discipline Committee (the Panel) of the College of Medical Radiation Technologists of Ontario found Ivan Jagarcic to have committed acts of professional misconduct in that he:
- failed to cooperate with the Quality Assurance Committee or any assessor appointed by that committee,
- failed to satisfactorily complete the Quality Assurance Portfolio for the year 2016,
- engaged in conduct relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional, and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the Quality Assurance Committee.
The Panel noted that Ivan Jagarcic had agreed to resign and never practice in Ontario, and imposed an order:
- requiring Ivan Jagarcic to appear via teleconference before the Panel of the Discipline Committee to be reprimanded on November 15, 2018.

A Panel of the Discipline Committee (the Panel) of the College of Medical Radiation Technologists of Ontario found Denise McBain to have committed acts of professional misconduct in that she:
- failed to satisfactorily complete the Peer and Practice Assessment – Multi-Source Feedback (MSF) Assessment for the year 2016,
- engaged in conduct relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional, and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the Quality Assurance Committee.
The Panel imposed an order:
- requiring Denise McBain to appear before the Panel of the Discipline Committee to be reprimanded on November 6, 2018; and
- directing Denise McBain to pay the College’s costs in the amount of one thousand five hundred dollars ($1,500.00), by November 30, 2018.

A Panel of the Discipline Committee (the Panel) of the College of Medical Radiation Technologists of Ontario found Catherine Vermeersch to have committed acts of professional misconduct in that she:
- failed to comply with a decision of the Inquiries Complaints and Reports (ICR) Committee,
- engaged in conduct relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional,
- failed to appear before a panel of the ICR Committee to be cautioned, and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the ICR Committee.
The Panel imposed an order:
- requiring Catherine Vermeersch to appear via teleconference before the Panel of the Discipline Committee to be reprimanded on October 31, 2018; and
- directing Catherine Vermeersch to pay the College’s costs in the amount of one thousand five hundred dollars ($1,500.00), by November 30, 2018.

October 25, 2018 |
A Panel of the Discipline Committee (the Panel) of the College of Medical Radiation Technologists of Ontario found Patrick Jew to have committed acts of professional misconduct in that he:
- failed to comply with a decision of the Inquiries, Complaints and Reports (ICR) Committee;
- engaged in conduct relevant to the practice of the profession that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional;
- failed to appear before a panel of the ICR Committee to be cautioned; and
- failed to comply with a requirement or order of a Committee or a panel of a Committee of the College, namely the ICR Committee.
The Panel imposed an order:
- requiring Patrick M. Jew to appear before the Panel of the Discipline Committee to be reprimanded on October 25, 2018;
- directing the Registrar to suspend Patrick M. Jew’s certificate of registration, commencing on November 30, 2018, until such time as he has complied with any remediation recommended as a result of the assessment of his quality assurance portfolio for the year 2016;
- directing the Registrar to impose specified terms, conditions or limitations on Patrick M. Jew’s certificate of registration, requiring that Patrick M. Jew must successfully complete the College’s online Jurisprudence Course and the online quiz for the Legislation Learning Package, by no later than November 30, 2018; and
- directing Patrick M. Jew to pay the College’s costs in the amount of one thousand five hundred dollars ($1,500.00), payable by certified cheque, on October 25, 2018.

Feras Salim |
October 25, 2018 |
A Panel of the Discipline Committee found Feras Salim, MRT(R), guilty of professional misdconduct in that he:
- engaged in conduct relevant to the practice of the profession, that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional, and
- failed to comply with an order of a committee of the College, namely the decision of the Inquires, Complaints and Reports Committee dated July 18, 2014.
Feras Salim admitted the allegations which relate to his failure to comply with a specified continuing education or remediation program (SCERP) ordered by the Inquiries, Complaints and Reports Committee (ICRC) in July 2014.
The SCERP ordered by ICRC required Feras Salim to submit his quality assurance records for the year 2012 which he had failed to submit when requested by the Quality Assurance Committee. Feras Salim submitted his quality assurance records for 2012 in August 2015, after the allegations of professional misconduct had already been referred to the Discipline Committee for a hearing by the ICRC in July 2015.
The Discipline Committee accepted a joint position on penalty from the College and Feras Salim and made the following order:
- The result of the Discipline Committee proceeding, including a synopsis of the decision, shall be on the register for an unlimited period of time pursuant to sections 23(2) and 23(14) of the Code,
- The finding and the Order of the Discipline Committee shall be published, in detail, with the name of Feras Salim in the annual report of the College and in any other publication deemed appropriate by the College, pursuant to sections 56(1) and 56(2) of the Code, and
- The member Feras Salim shall forthwith pay costs to the College in the amount of $2,500.00 pursuant to section 53.1 of the Code.

Jack Lossing |
March 20, 2013 |
A panel of the Discipline Committee found Jack Lossing, MRT(R), guilty of professional misconduct in that he:
- failed to cooperate with the Quality Assurance Committee,
- failed to carry out a requirement or order of the Quality Assurance Committee, and
- engaged in conduct in the course of practising the profession, that, having regard to all the circumstances, would reasonably be regarded by members as unprofessional.
Jack Lossing admitted each of the allegations which relate to his failure to submit his Self-Assessment Profile, Continuous Learning Portfolio and related Quality Assurance Records for 2010.
The Panel accepted a joint position on penalty from the College and Jack Lossing and made the following order:
- Jack Lossing shall have his certificate of registration suspended until such time as he has submitted his Self-Assessment Profile, Continuous Learning Portfolio and related Quality Assurance records for the calendar year 2010 and the materials have been deemed satisfactory by the Registrar (Note: Jack Lossing submitted the required materials, which were deemed satisfactory by the Registrar prior to the hearing and therefore a suspension of his certificate of registration was not imposed),
- Jack Lossing shall be reprimanded and the reprimand shall be recorded on the register for an unlimited period of time,
- The Order of the Committee shall be published, in detail, with the name of Jack Lossing in the annual report of the College and any other publication deemed appropriate by the College, and
Jack Lossing shall, prior to April 20, 2013, pay costs to the College in the amount of $2500.
